These Terms of Service (“Terms”) govern your access to and use of the website located at https://5squarehomes.com and any associated pages, sub-domains, brochures, calculators, forms, and digital services (collectively, the “Website”), operated by 5 Square Homes (“5 Square Homes”, “we”, “us”, or “our”).
By accessing, browsing, or using the Website — including by submitting an enquiry, subscribing to our newsletter, downloading a brochure, using the ROI calculator, or contacting us via WhatsApp through the Website — you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Website.
These Terms constitute a binding agreement formed by electronic means. In accordance with the Electronic Transactions Act, 2011 (Uganda), information and agreements are not denied legal effect solely because they are in electronic form, and your continued use of the Website constitutes your acceptance of these Terms.
We may update these Terms from time to time (see Section 15). Your continued use of the Website after any update constitutes acceptance of the revised Terms.
5 Square Homes is a premium real estate development company based in Uganda, specialising in residential and condominium developments, smart homes, and investment-focused properties.
You must be at least 18 years of age (the age of majority in Uganda) and have the legal capacity to enter into a binding contract to use the Website for any transactional purpose, including submitting enquiries or expressing interest in purchasing a property. By using the Website, you represent and warrant that you meet these requirements. The Website is not directed at children, and we do not knowingly collect personal data from children (see our Privacy Policy).
The Website is an informational, marketing, and lead-generation platform. It is intended to showcase our developments and projects (including, without limitation, Venue in Kyaliwajala, GIA in Lubowa, and Gaiety Place in Kyaliwajala), to allow you to learn about our offerings, and to enable you to contact us.
The Website does not process payments, accept deposits, or collect identity-verification (KYC) or financial documents. No purchase, reservation, booking, or contract for the sale of any property is made or completed through the Website. Any expression of interest submitted through the Website is an invitation to begin discussions only and does not create any binding obligation on you or on us. A binding agreement for the purchase of any unit arises only upon the execution of a separate written sale agreement (see Section 8).
All content on the Website — including text, graphics, logos, the “5 Square Homes” name and marks, architectural renders, floor plans, photographs, videos, brochures, and the design and layout of the Website — is owned by or licensed to 5 Square Homes and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website for your personal, non-commercial use. You may not, without our prior written consent:

The Website may provide tools such as an “ROI calculator” and content describing the investment potential of our developments.
5 Square Homes is a real estate developer. We are not a licensed financial adviser, investment adviser, securities dealer, or broker, and nothing on the Website constitutes financial, investment, tax, legal, or professional advice.
Any figures, projections, returns, yields, or estimates produced by the ROI calculator or presented anywhere on the Website are illustrative estimates based on assumptions only. They are not guarantees, representations, or warranties of any actual or future return, rental income, capital appreciation, or performance. Property values can fall as well as rise, and all property investment carries risk.
You should not rely on any such information when making a decision. We strongly recommend that you obtain independent professional advice from a qualified financial adviser, lawyer, and/or tax adviser, and conduct your own due diligence, before making any purchase or investment decision.
Some of our developments are sold on an off-plan basis or are at the proposed, planning, or construction stage, and may be delivered in phases.

The Website may contain links to third-party websites and to our profiles on third-party platforms (including Facebook, Instagram, LinkedIn, X, and TikTok), and may use third-party tools (such as WhatsApp). These are provided for convenience only. We do not control and are not responsible for the content, products, policies, or practices of any third party, and your use of any third-party service is governed by that third party’s own terms and privacy policy.
To the maximum extent permitted by applicable law, the Website and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Website will be uninterrupted, secure, error-free, or free of harmful components.
Nothing in these Terms excludes or limits any warranty, right, or remedy that may not lawfully be excluded or limited under the laws of Uganda or under any mandatory consumer-protection law that applies to you.
To the maximum extent permitted by applicable law, 5 Square Homes and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or in connection with your use of, or inability to use, the Website or any reliance on its content, even if we have been advised of the possibility of such damages.
Nothing in this Section limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for the non-waivable protections under the Condominium Property Act, 2001, or for any other liability that cannot be excluded or limited under applicable law.
We shall not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, civil unrest, government action or regulation, changes in law, labour disputes, supply-chain or materials shortages, utility or infrastructure failures, or failures of telecommunications or internet services.
You agree to indemnify and hold harmless 5 Square Homes and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Website, or your violation of any law or third-party right.
We may revise these Terms at any time by posting the updated version on the Website with a new “Last updated” date. Material changes will take effect on posting unless stated otherwise. We encourage you to review these Terms periodically. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.
These Terms, and any dispute or claim arising out of or in connection with them or your use of the Website, are governed by and construed in accordance with the laws of Uganda.
The parties shall first attempt to resolve any dispute amicably through good-faith negotiation. Where a dispute cannot be resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration in Kampala, Uganda, in accordance with the Arbitration and Conciliation Act (Cap. 4) of Uganda, before a single arbitrator appointed by agreement of the parties or, failing agreement, by the Centre for Arbitration and Dispute Resolution (CADER). The language of the arbitration shall be English. Alternatively, the parties submit to the exclusive jurisdiction of the courts of Uganda.
Where you are a consumer resident outside Uganda, this Section does not deprive you of the benefit of any mandatory protections available to you under the law of your country of residence.
